KlevaTutor Terms of Use

KlevaTutor provides a technology-enabled educational marketplace platform that connects parents, students, and learners with independent tutors offering virtual, in-person, and on-demand tutoring services. By using the platform, users acknowledge and agree that KlevaTutor: * Provides access to a technology platform and related support services only * Facilitates tutor discovery, matching, scheduling, communication, session management, and payment processing * Does not directly provide tutoring or educational instruction services * Does not employ, supervise, or control tutors as employees, agents, or representatives * Does not guarantee academic performance, examination results, admissions outcomes, grades, certifications, or specific learning outcomes All tutors using the platform operate as independent contractors and are solely responsible for: * The tutoring services they provide * Their qualifications, certifications, and experience * The accuracy of their profiles and representations * Their teaching methods, conduct, communications, and interactions with users * Compliance with applicable laws, tax obligations, licensing requirements, and professional standards KlevaTutor may conduct certain onboarding, verification, screening, assessment, or profile review processes for tutors; however, such processes do not constitute endorsement, certification, accreditation, or a guarantee of tutor quality, suitability, safety, or effectiveness. Parents and learners are responsible for evaluating tutor suitability and making independent decisions regarding engagement with tutors through the platform. KlevaTutor reserves the right to monitor platform activity, enforce platform policies, suspend or remove users, and take reasonable actions necessary to maintain the safety, integrity, security, and proper operation of the platform and Services.

Certain features of the KlevaTutor platform may require users to create an account and satisfy applicable eligibility requirements. By registering for, accessing, or using the platform, users represent and warrant that all information provided to KlevaTutor is accurate, current, complete, and truthful. Parents or legal guardians using the platform agree to provide accurate student information necessary for tutoring, scheduling, communication, educational support, and platform operations. Parents are responsible for ensuring that all applicable payments, subscriptions, tutoring fees, and financial obligations associated with the Services are paid in a timely manner. Parents and guardians are also responsible for supervising minors who use the platform, monitoring participation where appropriate, and ensuring that student activity complies with these Terms of Service, platform policies, and applicable laws. Students and learners using KlevaTutor are expected to participate respectfully, professionally, and appropriately during tutoring sessions and while interacting with tutors or other users of the platform. Students agree to: * Attend scheduled sessions on time and participate in good faith * Engage respectfully in educational activities and communications * Maintain appropriate conduct while using the platform and Services * Refrain from disruptive, abusive, harmful, unlawful, or inappropriate behavior KlevaTutor reserves the right to restrict, suspend, or terminate access to users who violate platform rules, misuse Services, engage in misconduct, or compromise the safety or integrity of the platform. All tutoring-related payments, subscriptions, marketplace fees, and related transactions must be processed through KlevaTutor’s approved payment systems and integrated payment providers. Applicable platform fees, processing charges, taxes, currency conversion fees, or related service charges may apply depending on the Services used. To protect the integrity and operational structure of the platform, users may not bypass KlevaTutor by arranging or accepting off-platform payments for tutoring relationships initiated through the platform. Students and learners under the age of eighteen (18) may only access or use the platform with the knowledge, involvement, consent, and supervision of a parent or legal guardian. Minor users must generally access the platform through a parent-managed or guardian-managed account unless otherwise expressly permitted by KlevaTutor. Parents and legal guardians remain fully responsible for: * Creating and managing student accounts where applicable * Providing accurate billing, payment, and contact information * Authorizing purchases, subscriptions, or financial commitments made through the platform * Supervising student activity and platform usage * Ensuring compliance with these Terms of Service and applicable platform policies Parents and guardians remain responsible for all activities, communications, bookings, transactions, and platform usage associated with student accounts under their supervision.

Tutor Eligibility Individuals registering as tutors on KlevaTutor must: * Be at least eighteen (18) years of age or the age of majority in their jurisdiction * Possess appropriate subject-matter knowledge, educational background, teaching ability, professional experience, or relevant expertise for the services they offer * Provide truthful, accurate, and complete information regarding qualifications, certifications, education, experience, and identity * Maintain professional conduct and comply with all applicable laws, regulations, and platform policies * Ensure that all content, tutoring services, and representations made through the platform are lawful and accurate KlevaTutor reserves the right to request verification documents, conduct assessments, review tutor profiles, or suspend or remove tutor accounts that contain inaccurate, misleading, fraudulent, or incomplete information. Tutor Responsibilities Tutors using the KlevaTutor platform agree to provide educational services in a professional, ethical, timely, and respectful manner. By offering services through the platform, tutors acknowledge and agree that they are solely responsible for the quality, accuracy, and delivery of the tutoring services they provide. Tutors agree to: * Deliver tutoring sessions and educational services professionally and within scheduled timeframes * Teach only subjects, topics, or educational areas in which they possess appropriate knowledge, qualifications, expertise, or experience * Maintain accurate, current, and truthful profile information, including qualifications, certifications, subject expertise, rates, and availability * Conduct communications with parents and students respectfully and professionally * Use the KlevaTutor platform for session scheduling, communications, service management, and payment processing related to platform-generated clients * Comply with all applicable laws, regulations, tax obligations, and platform policies KlevaTutor reserves the right to review tutor activity, investigate complaints, and suspend or terminate accounts that violate platform standards or policies. Non-Circumvention and Off-Platform Transactions To protect the integrity of the platform and support the continued operation of KlevaTutor, tutors may not bypass, circumvent, or attempt to avoid the platform’s payment systems, communication systems, subscription structure, or service processes. Tutors are prohibited from: * Accepting direct payments outside the KlevaTutor platform for students or parents introduced through the platform * Encouraging or requesting parents or students to move tutoring relationships off-platform * Sharing personal contact details, payment information, external booking links, or communication channels for the purpose of bypassing KlevaTutor fees or systems * Soliciting off-platform arrangements that avoid subscription fees, transaction fees, or platform policies Violation of these requirements may result in: * Immediate suspension or restriction of account access * Removal of tutor listings or platform visibility * Withholding of pending payouts where permitted by law * Permanent termination of the tutor account * Additional legal or financial action where applicable Subscription Plans and Platform Access Tutors access KlevaTutor through applicable subscription plans or service tiers, which may include plans such as Basic, Core, Growth, Enterprise, or other future offerings introduced by the platform. Subscription plans may include: * Student or session limits * Access to marketplace visibility and tutor discovery features * Student management and scheduling tools * Communication, analytics, or operational features * Additional platform benefits based on the selected tier An active subscription may be required for tutors to: * Accept or manage students * Continue offering tutoring services through the platform * Access certain platform tools or features * Receive payouts or maintain active tutor status Failure to maintain an active subscription or comply with subscription requirements may result in restricted platform functionality, reduced access to Services, temporary suspension, or limitations on account access and earnings. Tutor Payments and Payouts All tutoring-related payments facilitated through KlevaTutor are processed using approved payment gateways and financial service providers integrated into the platform. Payments made by parents or learners may be temporarily held for processing, verification, dispute prevention, operational review, or session confirmation purposes. Subject to applicable policies and processing timelines, tutor payouts may be released: * Upon confirmation or approval by the parent or learner, or * Automatically after a designated review or confirmation period, which may generally occur within approximately forty-eight (48) hours after session completion unless otherwise stated KlevaTutor may deduct applicable amounts from payments or payouts, including: * Platform or subscription fees * Payment processing or transaction fees * Currency conversion fees where applicable * Refunds, chargebacks, or dispute-related adjustments * Applicable taxes, regulatory fees, or legally required deductions Tutors are solely responsible for any personal tax reporting, income declarations, business registrations, or regulatory obligations associated with earnings received through the platform.

KlevaTutor supports a tutor-parent engagement model in which tutors and parents may establish their own cancellation expectations, scheduling terms, rescheduling policies, and session-related agreements at the beginning of their tutoring relationship (“Session Agreement”). While KlevaTutor provides the technology platform for scheduling, communication, payment processing, and session management, the platform does not impose mandatory cancellation policies between tutors and parents unless otherwise expressly stated. KlevaTutor is not responsible for enforcing custom agreements outside of the platform’s standard payment, session tracking, and completion processes. Session Completion and Payment Model KlevaTutor operates using a completion-based payment structure. Tutors earn payment based on the extent to which a tutoring session was successfully delivered and completed. Session payments may be calculated proportionally based on session completion, participation, engagement, session duration, attendance records, and platform activity data. In general: Tutor Earnings = Session Fee × Applicable Completion Percentage Completion determinations may include: * Zero percent (0%) completion where a tutor fails to attend or deliver the scheduled session * Partial completion where a session was only partially delivered or interrupted * Full completion where the tutoring session was substantially or fully delivered as scheduled Unless otherwise agreed between the tutor and parent, a tutoring session in which the tutor is present, actively engaged, and providing instruction for approximately thirty (30) minutes or more may generally be treated as a completed session. Missed Sessions and Attendance Where a tutor fails to attend a scheduled session without appropriate notice or acceptable justification, the session may be considered uncompleted, and the parent or student may not be charged. Where a parent or student misses, abandons, or fails to attend a scheduled session, the applicable outcome will generally be governed by the tutor-parent Session Agreement. If no separate agreement exists, the session may still be considered chargeable if the tutor attended the session as scheduled and remained available to deliver services. In situations where no custom cancellation or attendance terms have been established between the tutor and parent, KlevaTutor may apply the following default principles: * Sessions attended by the tutor may be considered chargeable * Sessions missed by the tutor may not be chargeable * Partially completed sessions may be prorated based on completion percentage or engagement Session Disputes and Resolution Any disputes relating to attendance, cancellations, session completion, payment eligibility, or tutoring delivery must be reported to KlevaTutor before payment release or payout completion. KlevaTutor may review available platform records and operational data, including: * Session timestamps and activity logs * Platform communication history * Session duration and participation records * Technical or system-generated attendance information * Other relevant operational or account activity Based on the available information, KlevaTutor may determine the applicable completion status, payment eligibility, or completion percentage associated with the session. Decisions made by KlevaTutor regarding session completion and payment calculations may be considered final and binding for purposes of platform processing and payout administration. Payment Release and Finality Payments processed through the platform may be temporarily held pending session completion, attendance confirmation, operational review, dispute handling, fraud prevention checks, or payment verification procedures. Once funds have been released to a tutor or otherwise settled through the platform: * The related session may be considered finalized and settled * Refunds, reversals, or payment disputes may be limited or unavailable except where required by law or determined by KlevaTutor in its discretion * KlevaTutor is not obligated to recover or reimburse funds already disbursed beyond amounts actually received or held by the platform Payment Processing and Third-Party Providers All payments processed through KlevaTutor may be facilitated using third-party payment processors, gateways, or financial service providers. Payment processors may include providers such as Stripe, Paystack, or other approved payment infrastructure providers used by the platform. KlevaTutor does not independently guarantee payment availability beyond funds successfully received, processed, or held through the applicable payment provider or platform systems.

To maintain a safe, secure, professional, and trustworthy learning environment, users of the KlevaTutor platform are prohibited from engaging in activities that violate these Terms of Service, applicable laws, or the rights and safety of others. Users may not: * Circumvent, bypass, or interfere with KlevaTutor’s payment systems, subscription structure, booking processes, or platform operations * Engage in fraudulent, deceptive, misleading, or abusive conduct * Impersonate another person or misrepresent identity, qualifications, credentials, or affiliations * Harass, threaten, exploit, intimidate, discriminate against, or otherwise harm other users of the platform * Share, upload, transmit, or distribute content that is unlawful, abusive, harmful, defamatory, sexually explicit, discriminatory, infringing, or otherwise inappropriate * Attempt to gain unauthorized access to accounts, systems, databases, or platform infrastructure * Introduce malicious software, spam, bots, automated scraping tools, or harmful code into the platform * Use the platform for illegal activities, unauthorized commercial purposes, or activities unrelated to legitimate educational services * Encourage off-platform transactions or attempt to avoid applicable platform fees or policies KlevaTutor reserves the right to investigate suspected violations and may suspend, restrict, or permanently terminate accounts involved in prohibited conduct. Where appropriate, KlevaTutor may also report unlawful activities to relevant legal or regulatory authorities.

Users of the KlevaTutor platform agree to respect the privacy and confidentiality of other users, platform information, communications, educational materials, and non-public data accessed through the Services. Users may not: * Disclose, distribute, publish, or share private, confidential, or personally identifiable information belonging to other users without proper authorization * Misuse, copy, exploit, sell, or improperly access platform data, account information, communications, educational resources, or proprietary content * Use confidential information obtained through the platform for unauthorized, harmful, competitive, unlawful, or non-educational purposes Users are expected to take reasonable steps to protect account credentials, session information, student data, tutor information, payment details, and other sensitive information associated with the platform. KlevaTutor reserves the right to investigate confidentiality breaches, unauthorized disclosures, or misuse of platform information and may suspend or terminate accounts involved in violations of this section.

KlevaTutor and all related Services are provided on an “as-is” and “as-available” basis without warranties, representations, or guarantees of any kind, whether express or implied. To the fullest extent permitted by applicable law, KlevaTutor disclaims all warranties relating to: * Continuous or uninterrupted platform availability or access * Accuracy, reliability, or completeness of platform content or Services * Tutor qualifications, conduct, performance, availability, or suitability * Academic achievement, examination results, admissions outcomes, grades, certifications, or specific learning outcomes * Compatibility, security, or error-free operation of the platform * Availability of sessions, communications, payments, or third-party integrations KlevaTutor does not guarantee that the platform or Services will always operate without interruptions, delays, technical issues, or errors. Users access and use the platform and Services at their own discretion and risk.

To the fullest extent permitted by applicable law, KlevaTutor shall not be liable for any claims, losses, damages, liabilities, costs, or expenses arising from or related to: * The conduct, performance, qualifications, actions, omissions, or services provided by tutors or other users * Academic performance, student progress, examination results, admissions outcomes, or other educational outcomes * Service interruptions, platform downtime, delays, technical failures, data loss, or third-party system issues * Indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, business opportunities, goodwill, or data KlevaTutor functions solely as a technology platform facilitating connections, scheduling, communications, and payment processing between users and does not assume responsibility for the independent actions or outcomes associated with tutoring services provided through the platform. To the maximum extent permitted by law, KlevaTutor’s total cumulative liability for any claim arising out of or relating to the platform, Services, or these Terms shall not exceed the total amount of fees actually paid to KlevaTutor by the applicable user during the two (2) months immediately preceding the event giving rise to the claim.

KlevaTutor reserves the right to suspend, restrict, disable, or permanently terminate user accounts, access to the platform, or related Services at its discretion where necessary to protect the platform, users, operational integrity, or legal compliance. Accounts may be suspended or terminated for reasons including, but not limited to: Violations of these Terms of Service or related platform policies Fraudulent, deceptive, abusive, or unlawful activity Misuse of the platform, Services, payment systems, or user information Harassment, harmful conduct, or inappropriate behavior toward other users Failure to maintain required subscriptions, fees, or payment obligations Actions that compromise platform security, operations, or reputation KlevaTutor may investigate suspected violations and may take appropriate action without prior notice where permitted by law. Users may choose to terminate or discontinue use of their accounts at any time, subject to any outstanding obligations, unresolved disputes, pending payments, active subscriptions, chargebacks, or other financial or contractual responsibilities associated with the account. Termination or suspension of an account does not eliminate obligations or liabilities accrued prior to the date of termination. Independent Contractor Relationship Tutors using KlevaTutor operate as independent contractors and not as employees, agents, partners, joint venturers, or representatives of KlevaTutor. Tutors are solely responsible for: Their own taxes, tax filings, and reporting obligations Obtaining and maintaining any required insurance coverage Compliance with applicable laws, regulations, licensing requirements, and professional obligations Managing their own business activities, schedules, pricing, and service delivery Any claims, liabilities, disputes, or obligations arising from the tutoring services they provide Nothing contained in these Terms of Service shall be interpreted as creating an employment, agency, partnership, or joint venture relationship between KlevaTutor and any tutor using the platform.

Users are encouraged to resolve concerns, disagreements, or service-related issues professionally and in good faith through the KlevaTutor platform and support channels. Any disputes relating to tutoring sessions, payments, cancellations, platform usage, user conduct, or related Services should be submitted to KlevaTutor through the designated support or dispute resolution process available on the platform. KlevaTutor may, at its discretion, review available information, facilitate communications between parties, or attempt to assist in resolving disputes; however, KlevaTutor is not obligated to mediate, arbitrate, investigate, or resolve disputes between users. Where KlevaTutor conducts a review or makes a determination regarding platform-related disputes, including session completion, payment eligibility, account activity, or policy enforcement, such decisions may be considered final for purposes of platform administration and operational processing.

These Terms of Service and any disputes arising from or relating to the KlevaTutor platform, Website, or Services shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict of law principles. KlevaTutor reserves the right to modify, revise, update, or discontinue any portion of these Terms of Service, platform policies, features, or Services at any time and at its sole discretion. Updated Terms may be posted on the platform or Website with an updated effective or revision date. By continuing to access or use the platform after any updates become effective, users acknowledge and agree to be bound by the revised Terms of Service.
