KlevaTutor Terms of Service

2. Platform Role KlevaTutor: • Provides a technology platform only • Facilitates matching, scheduling, communication, and payments • Does not employ Tutors • Does not guarantee learning outcomes or results All Tutors operate as independent contractors. 3. Account Eligibility Tutors must: • Be at least 18 years old • Possess subject-matter expertise • Provide accurate and truthful credentials Parents must: • Be legally authorized to make payments • Supervise minors using the platform Students: • Must use the platform under a Parent account if under 18 4. Tutor Terms 4.1 Tutor Responsibilities Tutors agree to: • Deliver services professionally and on time • Teach only subjects they are qualified in • Maintain accurate profiles • Use KlevaTutor for all sessions and payments 4.2 Non-Circumvention Tutors may not: • Accept payments outside the platform • Move Parents/Students off-platform • Share contact details to bypass KlevaTutor Violation may result in: • Immediate suspension • Permanent account termination 4.3 Subscription Model Tutors access KlevaTutor via subscription plans: • Basic, Core, Growth (or applicable tiers) • Student limits based on plan • Subscription required for active teaching Failure to maintain an active subscription may: • Restrict platform usage • Limit access to earnings 4.4 Payments to Tutors • Payments are processed through KlevaTutor • Funds are held until session completion • Payments are released: o Upon Parent confirmation, or o Automatically within 48 hours KlevaTutor may deduct: • Platform fees • Processing fees • Applicable taxes 5. Parent & Student Terms 5.1 Parent Responsibilities Parents agree to: • Make timely payments • Provide accurate student details • Monitor student participation 5.2 Student Conduct Students must: • Attend sessions on time • Behave respectfully • Engage in learning activities 5.3 Payments • All payments must be made through KlevaTutor • Platform fees may apply • Payments outside the platform are prohibited 6. Sessions and Service Delivery • Sessions are scheduled through KlevaTutor • Tutors are responsible for delivery • Parents/Students are responsible for attendance 7. Cancellation, Refunds, and Session Completion 7.1 Tutor–Parent Agreement Model Cancellation terms are defined and agreed directly between the Tutor and the Parent at the start of engagement (“Session Agreement”). KlevaTutor does not impose fixed cancellation rules and is not responsible for enforcing custom agreements beyond platform-defined completion logic. 7.2 Completion-Based Payment Model KlevaTutor uses a completion-based payment system: • Payment is earned only for sessions delivered • Payment is calculated based on percentage of completion Formula: Tutor Earnings = Session Fee × % Completion 7.3 Completion Definitions • 0% Completion → Tutor absent • Partial Completion → Session partially delivered • 100% Completion → Session fully delivered 7.4 Minimum Session Threshold • If a Tutor is present and actively engaged for 30 minutes or more, the session may be considered fully completed, unless otherwise agreed 7.5 Missed Sessions Tutor Missed: • Session = 0% completion • Parent is not charged Parent/Student Missed: • Governed by Tutor–Parent agreement • If no agreement exists: o Session is chargeable if Tutor was present 7.6 Default Platform Fallback If no cancellation terms are defined: • Tutor present → session chargeable • Tutor absent → no charge • Partial session → prorated 7.7 Dispute Resolution (Sessions) All disputes must be raised: • Before payment release • Through KlevaTutor support KlevaTutor will: • Review session logs, timestamps, and activity • Determine final completion percentage This decision is final and binding 7.8 Finality of Payment Once funds are released: • The session is considered fully settled • No refunds or reversals will be processed 8. Holding & Payment Processing • Payments are held securely until completion • KlevaTutor does not guarantee payment beyond received funds • Payment processors may include third-party providers 9. Prohibited Activities Users may not: • Circumvent platform payments • Engage in fraud or abuse • Harass or harm other users • Share inappropriate or illegal content 10. Intellectual Property • Platform content belongs to KlevaTutor • Tutors retain rights to their teaching materials • Students may not redistribute content 11. Confidentiality Users agree: • Not to disclose private information • Not to misuse platform data 12. Disclaimer of Warranties KlevaTutor is provided “as-is” without warranties, including: • Platform availability • Tutor performance • Learning outcomes 13. Limitation of Liability KlevaTutor is not liable for: • Tutor performance • Student outcomes • Indirect or consequential damages Maximum liability is limited to: • Fees paid in the last two (2) months 14. Termination KlevaTutor may suspend or terminate accounts for: • Violations of this Agreement • Fraud or misuse • Non-payment Users may terminate accounts subject to: • Outstanding obligations 15. Independent Contractor Relationship Tutors are independent contractors and responsible for: • Taxes • Insurance • Legal compliance 16. Dispute Resolution • Disputes should be submitted via platform • KlevaTutor may mediate but is not obligated • Platform decisions are final 17.
